Terms of Service
Last updated 2 October 2026
1. The agreement
These terms govern your use of SMSuni (smsuni.com.au), an Australian business SMS service operated by RPEQ Trading Pty Ltd, ABN 31 651 657 519. By creating an account or using the service you agree to them and to the Privacy Policy. SMSuni is offered to businesses and organisations for their own messaging.
2. The service
SMSuni lets you send SMS to Australian mobile numbers, receive replies, keep contact lists, run campaigns, use a developer API, and keep timestamped records of every message with exportable evidence packs. Messages are delivered through an Australian carrier. SMSuni does its best to keep the service available and to deliver messages promptly, but delivery depends on mobile networks and on the recipient's handset, and no availability or delivery-time guarantee is given.
3. Your account
- Give accurate account details and keep them current.
- Keep your password, two-factor codes, API keys and webhook secrets confidential. You are responsible for everything done with your account and keys.
- Tell SMSuni promptly if you believe your account has been used without authority.
4. Acceptable use
You must comply with Australian law, including the Spam Act 2003 (Cth) and the rules of the Australian Communications and Media Authority. In particular you must:
- have each recipient's consent before messaging them, and be able to show it;
- honour every opt-out. SMSuni records STOP and other opt-out replies and refuses later messages to that number from your account; you must not try to work around this;
- identify your business in your messages;
- not send content that is unlawful, misleading, defamatory, threatening, harassing, or that infringes another person's rights;
- not use the service for scams, unsolicited marketing to people who have not consented, or any purpose that would bring SMSuni or its carrier into disrepute.
SMSuni may suspend or close an account that breaches this section, and may refuse to send a message that it reasonably believes would breach it.
5. Fees, allowances and payment
- Prices are in Australian dollars and include GST. Current prices are published on the pricing page.
- Subscription plans are billed monthly in advance through Stripe. Each plan includes a monthly SMS segment allowance that resets at the start of each period; unused allowance does not carry over.
- Subscribers can buy a top-up of prepaid SMS credits. Top-up credits do not expire while the account is open.
- When your allowance and credits are used up, sending pauses until the next period or a top-up; SMSuni never charges an automatic overage.
- An upgrade to a higher plan applies immediately and the difference for the rest of the current period is charged on a prorated basis. A downgrade or a cancellation takes effect at the end of the current period.
- A message the carrier rejects outright is refunded in full to your allowance or credits. Once the carrier has accepted a message, its cost is not refunded if delivery later fails, because the carrier fee has been incurred.
- Except as set out above or as required by the Australian Consumer Law, fees are not refundable.
6. Cancellation and termination
You can cancel your subscription at any time from the billing page. Your plan stays active until the end of the period you have paid for, and prepaid credits remain usable while the account is open. SMSuni may terminate this agreement on notice if you breach it, or close the service on at least 30 days' notice. On closure you may export your message records before access ends.
7. Message records
SMSuni timestamps every message server-side, keeps sent messages unchanged, and lets you export records with integrity hashes. SMSuni is a record-keeping and communication platform, not a legal service: it does not advise on whether a message meets a contractual or statutory requirement, and you remain responsible for your own obligations.
8. Content and intellectual property
You own the contacts and messages you put into SMSuni and give SMSuni the licence it needs to store, process, deliver and back them up for you. SMSuni owns the service, its software and its documentation.
9. Liability
Nothing in these terms excludes a guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded. To the extent the law allows, SMSuni's liability to you for any claim arising out of the service is limited to the fees you paid in the month before the claim arose, and SMSuni is not liable for indirect or consequential loss, for loss caused by a mobile network or a carrier, or for loss caused by content you sent or by your own breach of section 4.
10. Changes, law and contact
SMSuni may update these terms; material changes are announced in the dashboard or by email before they take effect, and continued use after that is acceptance. These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction. Questions about these terms: admin@smsuni.com.
